1.1.- These General Terms and Conditions of Purchase (hereinafter, the “TERMS”) govern the legal relationship arising from the online purchase of products or services through the website https://spanishclasseslive.com (hereinafter, the “WEBSITE”), which may be purchased by any user who meets the requirements set out in these TERMS.
1.2.- These TERMS shall remain valid indefinitely and shall apply to all purchases made through the WEBSITE.
1.3.- Any person who makes a purchase or acquires a service through the WEBSITE (hereinafter, the “CUSTOMER”) shall be bound by these TERMS, and should therefore not place any order if they do not agree with any of their provisions. The provisions of the Legal Notice and the Privacy Policy published on the WEBSITE shall also apply to the online purchase of products or services through the WEBSITE.
1.4.- The online purchase of the products offered through this WEBSITE is available to both natural persons and legal entities:
By accepting these TERMS during the purchase process, the CUSTOMER declares and warrants that they meet these requirements. During the purchase process, the CUSTOMER will be asked to indicate whether they are placing the order as a consumer, for personal or non-professional purposes, or for purposes related to their business or professional activity.
1.5.- The CUSTOMER is solely responsible for the accuracy of all data provided through the WEBSITE’s online forms.
1.6.- Orders through this WEBSITE may only be completed in Spanish.
2.1.- The owner of the WEBSITE providing the online sales service is SPANISHCLASSESLIVE S.L. (hereinafter, the COMPANY or we), with Tax ID (CIF) B67900332, whose address and contact details are as follows:
2.2.- The COMPANY reserves the right to modify these TERMS at any time, without affecting purchases made through the WEBSITE prior to the modification. It is the CUSTOMER’s responsibility to review the current version of the TERMS before placing an order.
2.3.- We reserve the right to deny and/or withdraw access to this WEBSITE, at any time and without prior notice, to any users who fail to comply with these TERMS.
3.1.- The products or services offered for sale on this WEBSITE are those included on the website at any given time and available for purchase via a “BUY” button or similar, as described in the listing of their main characteristics.
The products or services offered for purchase are: Spanish as a foreign language classes and courses for students and teachers, including ELE and DELE preparation, and books in digital PDF or similar format, as well as subscriptions providing access to courses and digital content.
3.2.- The products and services are available for purchase in any territory without limitation (hereinafter, the “TERRITORY”).
3.3.- Live online classes, learning groups and scheduled training programmes are subject to availability, although flexibility is offered through various groups and timetables according to the calendars established, which will indicate the scheduled start and end dates. Class packs give students full flexibility of attendance according to their preferences or needs, while recorded courses have no set start or end dates and can be purchased and started at any time, at the pace each student considers best.
If for any reason a product or service is not available, the WEBSITE will display “not available” or similar. If, on the contrary, the WEBSITE does not report the unavailability of the product or service despite it being out of stock, we will contact the CUSTOMER to inform them of this circumstance and of the new date or, where appropriate, to offer an alternative product or service or to cancel the order with a full refund of any amount paid.
3.4.- We reserve the right to remove any product from this WEBSITE at any time, as well as to modify and update our catalogue of products and services.
3.5.- Classes require a minimum of two students to take place; otherwise, we reserve the right not to hold them and to wait until the minimum required number is reached, informing the customer personally.
4.1.- To purchase products on this website, you must be a registered user. Users can register via the “buy”, “start” or “start plan” buttons (or similar) found throughout the website, entering the personal data required as mandatory in each case, such as: e-mail address, identification details (first name and surname), contact details (full postal address) required for invoicing, company details if purchasing as a company, and payment details.
The CUSTOMER will then select their preferred payment method from those available on the WEBSITE. After that, they will be asked to tick the box accepting these TERMS and, optionally, to agree to receive informative communications and an invitation to leave a review of the product or service.
Contracting online and paying for the services following the procedure described implies full acceptance of these TERMS by the CUSTOMER.
Registering as a user gives you access to purchasing products through the website, stores your details for future purchases, speeds up your orders, keeps you informed about your orders and gives you access to the content you purchase.
4.2.- To complete your purchase, review the order shown on the right-hand side of the purchase screen. Your shopping cart will show a summary of your order, with the product, description, unit price and quantities. If you have a “coupon code”, you can enter it at this point and click “APPLY”. To proceed to payment and confirm your purchase, click the “BUTTON WITH PAYMENT OBLIGATION” or similar, such as “PLACE ORDER” or “COMPLETE PURCHASE”.
4.3.- Once the order has been placed, the CUSTOMER will receive an e-mail confirming the purchase (hereinafter, “ORDER CONFIRMATION”). If the CUSTOMER does not receive the ORDER CONFIRMATION within 24 hours of placing the order, they should notify us at our e-mail address.
4.4.- When submitting the order, the CUSTOMER may request the purchase invoice in electronic format by e-mail, as the system does not generate it automatically. Send us your invoicing details and we will send it to you as soon as possible. If for any reason you wish to receive the invoice on paper by post, let us know and we will proceed, with delivery subject to postal service timescales.
5.1.- Please note that with our learning method it is essential to take a level test so that you can enjoy the training that best suits your knowledge and needs. The level test should therefore be taken before purchase; if you have not done so, you can take it afterwards and you will be given manual access to the course according to the results of this test.
5.2.- The delivery of classes and courses takes place when the classes or courses begin on the training platform provided for this purpose. Books are considered delivered once the digital file has been received by the Customer.
Access to courses is immediate once the purchase has been completed and payment verified, using the access credentials obtained during the purchase process.
Access to classes is understood to occur once the student has joined the first class of the contracted pack using the access credentials obtained during the purchase process.
Books are considered delivered once received by the customer; the delivery period will be a maximum of 24 hours.
6.1.- When you purchase our training courses, you can access them from the moment you complete the purchase process, using the access credentials provided during registration. All you need is an internet connection and a browser of your choice. Courses cannot be downloaded, although some of the materials included in them can be.
The training services described above will be provided following the programme and methodology indicated in each case on the WEBSITE.
6.2.- The recording, reproduction or publication by any means of the courses and training sessions delivered in the performance of the contracted services is expressly prohibited.
6.3.- Attendance conditions must be optimal for the teacher and the students, so classes must be attended using stable connections, minimising external noise and/or situations that distract from the main learning objective. The teacher reserves the right to exclude students who do not meet minimum conditions in their access to classes.
6.4.- If, due to force majeure or unforeseen circumstances, the connection is interrupted for reasons beyond the parties’ control, you should contact the COMPANY to report the incident and arrange to make up or postpone the class, provided there is a justified reason.
6.5.- To guarantee student identification in classes, the use of the camera during classes is essential; otherwise, the teacher reserves the right to exclude any student who does not turn on their camera.
We use certain services/tools provided by suppliers located outside the EEA, specifically in the United States, which entails international data transfers. These services are: Zoho, a CRM for customer management and online chat, and WhatsApp for instant messaging communication. All providers of these services offer adequate data protection guarantees, having adopted standard contractual clauses in accordance with the current European Commission decision and/or being members of the “Data Privacy Framework (DPF)” agreement, which guarantees a level of data protection security equivalent to the European one.
7.1.- Except in cases of manifest error, the prices applicable to each product or service are those indicated on the WEBSITE in the order details, all inclusive of taxes; in our case, the Canary Islands General Indirect Tax (IGIC), which will be itemised at the end of the purchase process. Online classes are tax-exempt.
Although we try to ensure that all prices shown on the website are correct, errors may occur. If we discover an error in the price of any of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, the order will be considered cancelled and any amounts paid will be refunded in full.
7.3.- We reserve the right to modify the prices of products or services, but any changes will not affect orders for which we have already sent an ORDER CONFIRMATION.
7.4.- The CUSTOMER may pay using any of the methods enabled on the website at any given time, currently:
If, exceptionally, PayPal does not operate in your place of residence, contact the COMPANY and we will provide an alternative payment method by bank transfer.
In this case, you must e-mail us the transfer receipt to obtain your access credentials. If payment is not verified within the usual period, we will contact the buyer to resolve the issue, and we reserve the right to suspend your credentials until the issue is resolved and payment is verified.
7.5.- To enter credit or debit card details, the CUSTOMER must be the legitimate cardholder and entitled to use it. The CUSTOMER is responsible for ensuring that all data provided for the purpose of purchasing products are correct.
7.6.- The WEBSITE uses the secure communication protocol https and holds a valid security certificate, guaranteeing the secure transmission of information through encryption. The COMPANY will not have access to the CUSTOMER’s financial data.
7.7.- Some of our services allow payment in instalments, as indicated on the website. If you choose this method, please note the following:
8.1.- The customer may withdraw from the order placed, i.e. request its return and subsequent refund, without needing to state a reason and without incurring any cost other than shipping costs, which shall be borne by the consumer and/or user (if any), within 14 calendar days from the date of the order confirmation.
The customer acknowledges and accepts that there will be no right of withdrawal if they have accessed the course or the classes before the end of that 14-day period, in accordance with Article 103.m of Spanish Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, which establishes the following:
“The right of withdrawal shall not apply to contracts relating to:
m) The supply of digital content which is not supplied on a tangible medium if the performance has begun and, if the contract imposes on the consumer or user an obligation to pay, where the following conditions are met:
1. The consumer or user has given prior express consent to begin the performance during the right of withdrawal period.
2. The consumer or user has acknowledged that they thereby lose their right of withdrawal;”
In the case of books, the right of withdrawal is deemed to lapse once they are sent, as they are supplied without a tangible medium.
This therefore applies to courses, classes and PDF books alike.
8.2.- To exercise the right of withdrawal, the CUSTOMER must notify us of their decision to withdraw from the order by means of an unequivocal statement, which may be sent to our e-mail address: hola@spanishclasseslive.com. For this communication, you may use the model withdrawal form found at the end of this document, although its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of this right to be sent before the corresponding deadline expires.
In the event of withdrawal by the CUSTOMER, we will refund all payments received for the affected order without undue delay and, in any event, no later than 14 calendar days from the date on which the CUSTOMER informs us of their decision to withdraw from the contract. We will make this refund using the same payment method used by the CUSTOMER for the initial transaction, unless the CUSTOMER has expressly stated otherwise, and provided the CUSTOMER does not incur any costs as a result of the refund. We may withhold the refund until we have verified that the CUSTOMER has not accessed the service and is within the legal withdrawal period.
8.3.- Notwithstanding the above, the CUSTOMER may cancel orders placed through this website, subject to the cancellation conditions set out in the following section, “order cancellation and modification policy”.
9.1.- To cancel an order, the customer may do so by e-mail at hola@spanishclasseslive.com or by calling Customer Service on +34 672883943. Cancellation is possible up to 24 hours before the start of the training. This clause does not apply to subscriptions, which are governed by clause 10.
9.2.- You may also modify or reschedule your order up to 24 hours in advance by contacting the company and explaining your specific case, to explore the possibility of changing dates or levels.
10.1.- Some products on the WEBSITE are offered on a subscription basis for fixed periods (quarterly, six-monthly or annual), according to the duration and price indicated on the product page and during the purchase process.
10.2.- Unless previously cancelled by the CUSTOMER, the subscription renews automatically at the end of each period, for a period of equal duration and at the current price indicated on the WEBSITE.
10.3.- The CUSTOMER may cancel the renewal at any time, with no minimum commitment or penalty, from their user account or by writing to hola@spanishclasseslive.com. To prevent the next charge, cancellation must be made before the renewal date shown in your account. Cancellation takes effect at the end of the current period, and access is maintained until that date. Periods already started are not refunded, either in full or in part.
10.4.- The right of withdrawal regime set out in section 8 applies to subscriptions, including the exception provided for the supply of digital content with immediate access (Article 103.m LGDCU).
10.5.- The COMPANY may update the subscription price for future periods, notifying the CUSTOMER reasonably in advance of the renewal so that they can cancel it before the new price takes effect.
10.6.- In subscriptions that include live classes, the CUSTOMER has access during each period to the sessions scheduled in their group calendar. The price of the period covers making those sessions available, whether or not the CUSTOMER attends. Unused sessions do not give rise to any right to a refund, discount or compensation, and they do not accumulate or carry over to later periods. If Spanishclasseslive cancels a scheduled session for reasons attributable to it, including failure to reach the minimum number of students set out in clause 3.5, the session will be rescheduled or replaced with an equivalent one.
11.1.- The CUSTOMER can send us complaints or claims through our e-mail address hola@spanishclasseslive.com.
We will endeavour to respond to such complaints or claims as quickly as possible.
11.2.- We also inform CUSTOMERS who qualify as consumers or users that, in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council, they were entitled to request the out-of-court resolution of consumer disputes through the EU online dispute resolution platform, available until 20 March 2025.
The COMPANY, as data controller, will process the data provided by the CUSTOMER during the online purchase process for the purpose of the administrative and financial management of the purchase, including invoicing, collection and related operations, as well as for managing the customer account. You can find more information about the processing of personal data in our privacy policy.
13.1.- The relationship between the COMPANY and the CUSTOMER arising from orders placed through this WEBSITE shall be governed by Spanish law.
13.2.- For the resolution of disputes, and waiving any other jurisdiction, the parties submit, at their choice, to the competent Courts and Tribunals of the CUSTOMER’s place of residence, provided the CUSTOMER acts as a consumer or user. Otherwise, jurisdiction shall lie with the Courts and Tribunals of the city of Las Palmas de Gran Canaria.
